Axl Rose video game lawsuit suffers blow

(WENN) Guns N' Roses frontman Axl Rose has suffered a blow after part of his lawsuit against a computer game manufacturer was thrown out.

A judge in Los Angeles has dismissed the musician's claim accusing Activision Blizzard of unlawfully using his band's music and an image of guitarist Slash in Guitar Hero III: Legends of Rock, which launched in 2007.

The rocker's allegation of fraud and an attempt to win damages of $20 million were thrown out because the delay in submitting the lawsuit until 2010 passed the statute of limitations.

However, a breach of contract allegation has been allowed to remain after the musician claimed bosses at the company failed to release a Guns N' Roses themed game as an agreement between both parties to settle the dispute.

The case will go to court next February.
